Terms of Use

Effective Date: August 23, 2026   ·  Last Updated: August 23, 2026

These Website Terms of Use ("Terms") govern your access to and use of careoncall.org and its related webpages (collectively, the "Website"), operated by Care-on-Call ("Care-on-Call," "we," "us," or "our").

By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

1. Scope and Purpose

The Website provides general information about Care-on-Call, its team, non-medical in-home care services, office locations, frequently asked questions, employment opportunities, and contact information.

The Website may also link visitors to external employment-application, payment, mapping, and social-media services.

These Terms govern Website use only. They do not replace any separate client service agreement, care plan, employment document, invoice, payment agreement, or other written agreement with Care-on-Call.

The Website does not provide user accounts, passwords, client dashboards, or a member portal.

2. Care Services and Medical Disclaimer

Care-on-Call provides non-medical in-home care services. Website descriptions of services are general and do not guarantee the availability of a particular service, caregiver, schedule, location, or care arrangement.

Using the Website or contacting Care-on-Call does not create a client-provider relationship. Before services begin, Care-on-Call may require an assessment and a separate written client service agreement.

The applicable service agreement will control pricing, scheduling, minimum visit requirements, caregiver assignments, cancellations, payments, and other service conditions. If Website content differs from a signed agreement, the signed agreement will control.

The Website does not provide medical advice, diagnosis, treatment, nursing advice, or emergency assistance. If you believe someone is experiencing a medical emergency, call 911 immediately.

3. Acceptable Website Use and Communications

You may use the Website only for lawful, personal, and informational purposes.

You may not:

  • Attempt to gain unauthorized access to the Website or its systems;
  • Introduce malicious software or interfere with Website operation;
  • Use the Website for fraudulent, misleading, or unlawful activity;
  • Impersonate Care-on-Call or another person;
  • Misuse Care-on-Call's name, logo, or content; or
  • Use automated tools in a manner that disrupts the Website or creates an unreasonable burden on its systems.

Ordinary indexing by legitimate public search engines is permitted.

Visitors may contact Care-on-Call using the telephone numbers and email addresses displayed on the Website. Sending an email or leaving a message does not guarantee an immediate response, consultation, acceptance as a client, or availability of services.

Do not use the Website, email, or social media for emergencies or to send unnecessary sensitive medical, financial, or identification information.

4. Careers and Employment Applications

The Website may display caregiver vacancies, job descriptions, employment locations, schedules, and qualifications.

Job listings may be changed, filled, suspended, or removed at any time. A listing does not constitute an employment offer, employment contract, or guarantee that a position remains available.

Employment applications are submitted through a third-party form provider. Applicants are responsible for reviewing the notices, consent language, terms, and privacy practices displayed within that form.

Applicants agree to provide truthful and accurate information. Submitting an application does not guarantee an interview, job offer, or employment.

Any employment relationship will be governed by applicable law and separate employment documents, not by these Website Terms.

5. Payments and Third-Party Services

The Website may provide links to external services, including:

  • Payment platforms;
  • Employment-application forms;
  • Google Maps or other mapping services; and
  • Social-media platforms.

Care-on-Call does not operate or control these third-party services and is not responsible for their availability, security, content, terms, or privacy practices.

Online payments may also be governed by the payment provider's terms, the applicable Care-on-Call invoice, and the client's service agreement. These Website Terms do not determine the amount owed or create separate refund, credit, or cancellation rights.

Visitors should review the applicable third-party terms and privacy policies before submitting information or payment details.

6. Privacy

Use of the Website is also subject to the Care-on-Call Privacy Policy.

The Privacy Policy explains how information associated with the Website may be collected, used, and disclosed.

Third-party services linked from the Website collect and process information under their own privacy policies. Care-on-Call does not control the privacy practices of those third parties.

7. Intellectual Property

Unless otherwise indicated, the Website and its original text, design, graphics, logos, photographs, videos, job descriptions, and other materials are owned by or licensed to Care-on-Call.

Visitors may view or print reasonable portions of the Website for personal, non-commercial use.

Without prior written permission, Website content may not be reproduced, republished, modified, sold, commercially distributed, or used to suggest an unauthorized relationship with or endorsement by Care-on-Call.

Testimonials displayed on the Website describe individual experiences. They do not guarantee that another client, family, applicant, or employee will receive the same result.

8. Website Availability, Disclaimers, and Liability

Care-on-Call makes reasonable efforts to keep Website information useful and current but does not guarantee that all content will always be complete, accurate, available, or up to date.

Services, employment opportunities, links, and Website features may be changed or removed without notice.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT EXPRESS OR IMPLIED WARRANTIES.

TO THE FULLEST EXTENT PERMITTED BY LAW, CARE-ON-CALL AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF, INABILITY TO USE, OR RELIANCE ON THE WEBSITE OR A THIRD-PARTY SERVICE LINKED FROM IT.

These limitations apply to Website use only. They do not replace any obligations contained in a separate signed service or employment agreement and do not limit rights or liability that cannot legally be limited.

9. Changes, Governing Law, and General Terms

Care-on-Call may update these Terms when its Website, services, or practices change. The "Last Updated" date will be revised when changes are published.

Unless otherwise required by law, updated Terms become effective when posted on the Website.

These Terms are governed by the laws of the State of California. To the extent permitted by law, proceedings relating specifically to these Terms or Website use must be brought in the state or federal courts located in Santa Clara County, California.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Care-on-Call's failure to enforce a provision does not waive its right to enforce that provision later.
